Rental Conditions and Cancellation Policy
1. IDENTIFICATION OF THE PARTIES
On the one hand, TK INMOSERVICES, whose full details are set out in the Legal Notice and which is the owner of the domain www.inmoservice.com, hereinafter referred to as the ‘Website’; and on the other hand, the User, who contracts the services offered via the Website. TK INMOSERVICES and the User may be referred to as the ‘Parties’ depending on the context.
2. SCOPE OF APPLICATION, ACCEPTANCE AND AMENDMENTS
These General Booking Terms and Conditions (hereinafter referred to as the “GBTC”) govern booking contracts between TK INMOSERVICES and the User, regardless of the channel through which the booking is made: website, email or telephone.
The User, who declares that they have sufficient legal capacity* to enter into a contract, shall be bound by these GBTC from the moment they make a booking via any of the channels indicated above.
The GBR may be subject to unilateral amendment by TK INMOSERVICES without prior notice; however, the User shall be bound by those in force at the time the booking is made.
Any specific conditions that may apply, or any amendment to these GBR, must be formalised in a separate document, which, to be valid, must be signed by both parties.
*LEGAL RESTRICTIONS: It is understood that the User is not under the age of 18. Minors are technically restricted from registering on this website and therefore may not make purchases or bookings, in compliance with legal regulations. Data sent by minors will not be processed, as this is prohibited by law.
3. TERMS OF PAYMENT, PRE-CONTRACTUAL AND CONTRACTUAL FINALISATION
As previously mentioned, bookings can be made via three channels: the website, email or telephone.
To confirm the booking, 30% of the total rental price (excluding charges) must be paid.
The remaining 70% of the rental price (excluding charges) must be paid at least 30 days prior to arrival.
The remaining payment (including the deposit and any additional charges) must be paid no later than on arrival and upon handover of the keys; however, should this percentage vary, the User will be informed in advance via the Website or by email, depending on the booking channel chosen.
During the high season, from June to September inclusive, the minimum stay is 7 days. Exceptions may apply. During the rest of the year, the minimum stay is 4 days in most properties.
The parties shall be bound by this contract upon payment of the booking.
Signing the rental contract implies acceptance of each and every one of these terms and conditions, regardless of the booking channel through which the reservation was made: by telephone, via the Website, or through booking agencies or tour operators with which TK INMOSERVICES has partnership agreements.
Furthermore, renting one of our properties implies acceptance of the specific terms and conditions applicable to the rented property, as set out in the booking contract sent to the User.
4. METHODS OF PAYMENT
The following payment methods are available to the User:
- Bank transfer to the account specified in the rental agreement.
- Cash (for any outstanding balance, additional charges or the security deposit).
Postal orders and holiday vouchers will not be accepted as a form of payment.
5. PRICES AND APPLICABLE TAXES
The published prices for accommodation vary depending on the week chosen and include the applicable VAT.
Accommodation prices are indicated, as applicable, per month, per week or per day. TK INMOSERVICES accepts no liability for any errors in the published prices; in such cases, the User will be duly informed of this circumstance and may choose either to book the service at the correct price or to cancel the said services without any cost or penalty.
Rental prices vary depending on the property and the season. Prices are clearly detailed on the website; you may also contact the agency.
TK INMOSERVICES reserves the right to amend the price list published on the website whenever it deems appropriate. In any event, this shall not apply to services contracted prior to the amendment.
6. OBLIGATIONS OF THE PARTIES
6.1. Obligations of TK INMOSERVICES
- To provide the services in accordance with the General Terms and Conditions and in good faith.
- To make the General Terms and Conditions and any specific terms and conditions that may apply available to the User.
- To provide the User with a receipt or invoice for the services contracted.
6.2. Obligations of the User
- To comply fully with the provisions of the General Terms and Conditions and, where applicable, with any specific conditions that may apply.
- To complete the registration forms with accurate and up-to-date information. The User shall be solely responsible for the accuracy and up-to-date nature of the information.
- Maintain the confidentiality of the information provided and immediately notify the company of any loss, misplacement, theft, unauthorised access, or disclosure to third parties.
- Comply with the rules of the owners’ association to which the property may belong.
- Adhere to the number of occupants specified in the booking.
- To leave the property in the same condition as it was upon arrival.
- To act diligently, adhering at all times to the principles of good practice and contractual good faith throughout the duration of the contractual relationship.
7. CANCELLATION POLICY
In the event of cancellation, changes or no-shows, the following penalties will apply:
- Cancellation is permitted up to 30 days before the start of the rental period in the event of serious circumstances. In this case, the deposit paid for the booking will be retained by the landlord as compensation (30%).
- If the contract is cancelled less than 30 days before the start of the rental period, the full rental amount must be paid, excluding expenses.
For this reason, we recommend taking out travel cancellation insurance. The company does not offer any form of insurance, so you will need to arrange this with your own insurer.
The penalty amount will be used to cover the costs incurred and any damage suffered, as well as for loss of earnings.
No refund will be made to the User if they decide to vacate the accommodation before the end of the contracted stay.
TK INMOSERVICES reserves the right to replace the booked accommodation with another of similar characteristics in the event of a serious unforeseen circumstance that prevents the customer from enjoying their stay in the intended property. Should it not be possible to replace the property with one of similar characteristics, or should the User not be satisfied with the proposed property, TK INMOSERVICES will offer a change of dates or the cancellation of the booking, refunding the User the full amount paid.
TK INMOSERVICES carries out regular inspections of the rental properties to prevent any issues arising during the Tenants’ stay. We would therefore be grateful if Tenants could report any issues or make any suggestions during their stay to help us improve our service.
If you find a fault or defect in the accommodation, you are expected to report it immediately to avoid any misunderstandings. In the event of a serious complaint, you must report it immediately to TK INMOSERVICES. This will enable us to resolve your complaint as soon as possible. The company has complaint forms available should you require them.
8. SECURITY DEPOSIT
TK INMOSERVICES may require the payment of a security deposit. The amount of the security deposit will vary depending on the property and must be paid in cash upon arrival at the latest, or by bank transfer a few days before arrival.
The User will be informed of the amount of the security deposit before the booking is confirmed.
The deposit will be refunded once the stay has ended. However, the deposit is subject to any compensation payable for loss and/or damage to the property that is attributable to the User and other occupants of the accommodation.
The deposit will be refunded within a maximum of 4 weeks after departure, by bank transfer, once any applicable amounts have been deducted for damage caused by the tenant, loss of keys or items, and tampering with the TV and Wi-Fi settings. The User must remove any rubbish generated during their stay in the accommodation; furthermore, if a barbecue is used, they must keep it clean. Otherwise, an amount of €50 will be deducted from the deposit for cleaning the barbecue, and €50 for rubbish left in the accommodation. Any damage not disclosed at checkout will be documented and similarly deducted from the deposit. In the event that the damage caused exceeds the amount of the deposit, the agency reserves the right to claim compensation from the tenant for the respective cost.
If the damage and/or loss to the property exceeds the amount of the deposit, the User shall be obliged to pay the corresponding difference before leaving the accommodation.
The User must immediately notify TK INMOSERVICES of any loss and/or damage to the property.
9. CHECK-IN AND CHECK-OUT
Check-in:
- Check-in is from 4.00 pm. Exceptions may be made in certain cases.
Check-in takes place at the property itself, where a member of staff from the agency will explain in detail how the property works and provide a brief overview of the local area.
We therefore recommend that you provide your estimated arrival time and notify the agency 30–40 minutes before you arrive.
On arrival, you will be asked to present the identity cards of all guests aged 16 and over.
Check-out:
- Check-out must take place before 10:00 am. Exceptions may also be made where applicable.
On the day of check-out, a representative from the agency will visit the property to read the electricity meter, inspect the house and collect the keys.
If you arrive outside of opening hours, an additional charge may apply:
20:00–22:00 → 50€
22:00–24:00 → 100€
00:00–02:00 → 150€
02:00–08:00 → 250€
We are always available to assist customers 24 hours a day in the event of an emergency.
10. MISCELLANEOUS
A final cleaning fee is a mandatory charge that varies depending on the property; additional costs may also apply, such as Wi-Fi (if required) in some properties or a pet supplement, where applicable. However, all these details will be clearly stated in the rental contract.
Below is a list of the extras you can add during the booking process, if you wish:
- Towels and bed linen (15€ /person and 15€ /person)
- Bringing a pet, provided this is permitted at the property
(50€ /pet) - Cot and/or high chair (20€ each or 30€ for both)
- Late arrivals (from 8 pm, see prices in section 9)
- Extra cleaning (20€ /hour) during your stay (please contact the agency to arrange a date and time)
- Extra bed (60€)
- Wi-Fi internet on request 5€ /day, if the property does not have it
For long-term bookings (28 days or more), special rates apply; therefore, the following additional charges apply:
- Wi-Fi
- Water: 30€ /month (for apartments and bungalows) and 45€ /month (for villas and chalets)
- Electricity: charged according to consumption
- Gas: charged according to consumption
- etc.
11. LIABILITY
11.1. User Liability
Any User who books accommodation for themselves and other Users shall be liable for the full payment of the rent and for any damage caused to the rented property.
The booking shall be valid for the number of people specified in the booking contract. Accommodating more people than those specified is not permitted, and exceeding the permitted occupancy may result in the termination of the rental contract without refund and the forfeiture of the deposit. If the User intends to accommodate more people than permitted in the rented property, they must consult TK INMOSERVICES.
Pets are not permitted in all properties. The User is obliged to check with TK INMOSERVICES whether pets are permitted in the property. The additional charge per pet is €50 per stay. If it is found that the User has brought a pet into a rented property where pets are not permitted, the company is authorised to cancel the rental without refund.
Celebrations or parties:
These are only permitted if the number of guests is equal to or less than the maximum number of guests allowed in the property, provided that the relevant timings and rules in force at each property are observed.
Garden and swimming pool:
Properties with a garden and/or private swimming pool require regular maintenance. As a general rule, this is usually once or twice a week. Our trusted professional has a key to access the property to minimise disruption.
Electricity:
For short stays, 85 kWh per week is included for apartments/bungalows and 150 kWh per week for villas. Upon arrival, the electricity meter reading is noted in the guest’s presence, as is the case on departure. In the event of consumption exceeding the agreed limit in the rental contract, the difference will be charged at €0.40/kWh. For long-term stays (28 days or more), charges will be based on the meter reading. Guests are advised to use the heating or air conditioning responsibly and reasonably to avoid additional costs during their stay.
House keys:
The User will be provided with one or two full sets of keys to the property. Should the User fail to return or lose the keys provided, the cost of replacing the keys – and, if necessary, changing the locks – will be deducted from the security deposit.
Additional extras:
TK INMOSERVICES offers Users various extras for their rentals, such as: extra beds, cots, high chairs, etc. The prices for these extras are listed in the ‘Prices’ section. You can also enquire about them directly with the company TK INMOSERVICES.
Internet/Wi-Fi:
This is only available if specifically stated in the property description. In some properties, there is a charge for internet access; this will be shown at the time of booking. The Wi-Fi connection is a service contracted by the owner for activities that do not consume a large amount of data, and no claims can be made in the event of speed issues or a lack of connection.
Satellite/cable TV:
If the description mentions satellite or cable TV, this does not automatically mean that you will be able to receive all the channels you wish. The properties are equipped with decoders that are not always capable of receiving all international channels. This will depend entirely on the type of decoder.
Water and electricity:
There may be occasional interruptions to the water and electricity supply due to the increase in the number of residents in the area, particularly during the high season. Under no circumstances may the company or the property owner be held liable for any inconvenience or damage caused by such disruptions.
Construction work:
The properties are generally privately owned by various individual owners and are usually situated in large residential areas, so it may occasionally happen that unexpected construction work takes place in the vicinity. Such work is usually carried out by owners, building contractors or government organisations, so we have no influence over these activities. Neither the owner nor the company accepts any liability for any inconvenience caused by building works not carried out on the instructions of the person responsible for the accommodation.
Accidents and theft:
Neither TK INMOSERVICES nor the property owner shall be held liable for any damage or loss (including injury, illness, death, damage to property or theft) suffered by the User or their companions during their stay. By making the booking, the User agrees to assume responsibility for their own personal safety and that of their belongings, and releases the company and the property owner from any liability in this regard. To minimise potential risks, please take particular care when using the kitchen and the swimming pool, as these are areas of the property that present additional risks to the User, and ensure that all doors and windows on the property are properly closed.
11.2. Company Liability
TK INMOSERVICES shall not be liable in any way for any loss and/or damage suffered by the User and the occupants during the tenancy.
TK INMOSERVICES may amend or cancel any of the essential terms of the tenancy agreement in the event of force majeure or unforeseeable circumstances.
12. BREACH OF CONTRACT
Both contracting parties shall fulfil the obligations assumed under this contract in accordance with the terms set out herein. In the event that either party fails to fulfil any of the essential obligations of this contract, or fulfils them in a defective manner, the party which has fulfilled its own obligations may consider that there has been a breach of contract in accordance with the terms set out in Article 1.124 of the Civil Code, and shall be entitled to choose between terminating the contract or demanding performance, claiming, in both cases, the corresponding compensation for damages.
13. RIGHT OF WITHDRAWAL
In accordance with Article 103(L) of Royal Legislative Decree 1/2007 of 16 November, approving the Consolidated Text of the General Law on the Protection of Consumers and Users, “The right of withdrawal shall not apply to contracts relating to: The provision of accommodation services for purposes other than residential use, the transport of goods, vehicle hire, catering or services related to leisure activities, if the contracts specify a specific date or period of performance”.
14. NOTIFICATIONS
TK INMOSERVICES designates the address specified in the Legal Notice as its address for the purposes of service of notice. The email address provided by the User during the registration process will be used by TK INMOSERVICES for the purposes of sending notices. All notices sent in accordance with the procedure set out above shall be deemed to have been validly served.
15. COMPETENT JURISDICTION
In the event of a dispute between the parties, jurisdiction shall lie exclusively with the court in the area where the property being let is situated.
